Peak Ecology’s ecologists have considerable experience in the identification and methods of control for Schedule 9 invasive non-native plant species (INNS). Legislation and Ecology
Schedule 9 of the Wildlife and Countryside Act (1981) contains measures for preventing the establishment or spread or species of non-native invasive plants which are detrimental to native wildlife. Under this legislation, there is not a requirement to remove these plants or control them on your private land but allowing them to grow on someone else’s property or land could lead to prosecution or being given a community protection notice for causing a nuisance. Offences may be caused by moving soils or spoil contaminated, with invasive species fragments or plant cuttings. It is also illegal to import, transport, keep, breed, sell, use or cultivate, or release into the environment any plant species on Schedule 9. Waste containing invasive plant material (seeds, roots and other parts) is classed as ‘Controlled Waste’ and is subject to control under waste legislation.
Invasive plants, particularly Japanese knotweed, giant hogweed, Himalayan balsam and New Zealand pigmyweed, are very problematic and can impact on development plans with both time delays and financial implications.
If non-native invasive plant species are found on site a management plan or method statement will be required, either as part of the planning application or as a planning condition. After identifying and mapping invasive species, options are discussed and a plan prepared to suit all parties which will ensure legal compliance and minimise delays.
